Definitions and Interpretation

These Booking Terms & Conditions set out our obligations to you and your commitments to us when you book a package with us. These Booking Terms & Conditions, together with any email correspondence with us and any information provided on our through our website, form our contract with you.

  1. “we” “us” and “our” are references to 10051128 Canada Inc. doing business as “CARTE BLANCHE PARTIES”.
  2. “you” or “your” means any or all people participating as guests in the one, several or all of the Experiences of a Booking.
  3. “Head Organizer” refers to individual who originally made the booking with us.
  4. “Experience” means any indoor or outdoor Experiences, events, entertainment, transportation, meals and other services of whatever description, booked through us for you.
  5. “Booking” means one or more Experiences which have been you have requested to book through us for you for a specific day(s) and for which we have sent an official booking confirmation to you via email.
  6. “our email address” refers to info@carteblancheparties.com

  1. Bookings

Upon you requesting to make a booking, it will be regarded that you have read, understood and agreed to these Booking Terms and Conditions. It is the responsibility of the Head Organizer to ensure that all guests have read, understood and agreed to these Booking Terms & Conditions before the booking is requested.

The individual who made the booking is deemed to be the Head Organizer of that booking, and therefore has the authority to deal with us and make decisions on behalf of his group.

If for any reason the Head Organizer no longer wishes to undertake the role, he / she must make known this decision by informing us through email, naming a new Head Organizer and providing his contact information.

If for any reason the other guests wish to change the Head Organizer, at least 2/3 of all guests must indicate their wish to change the Head Organizer via email, and at the same time, cast a vote for a new Head Organizer. The guest with the most votes will become the new Head Organizer.

2. Payment

For bookings made 7 days or more in advance:

Once a non-refundable payment of one guest’s cost is paid towards the Booking, your booking will be confirmed. Payment for all remaining guests is due 7 days before the event at the latest.

Since all bookings have a minimum and maximum number of guests, your final number of confirmed guests will be implied by how many guests have been paid for by the payment deadline.

If the minimum amount of guests has not been paid for by the deadline, your booking will be cancelled. All amounts paid to us towards the booking EXCEPT the original non-refundable payment of one guest’s cost will be refunded.

For bookings made 7 days or less in advance:

*Bookings made less than 7 days in advance are charged a 15% “last-minute” premium.*

Once a non-refundable payment of the cost of 4 guests is paid towards the Booking, your party will be confirmed. Payment for all remaining guests is due 72 hours before the event at the latest.

Since all bookings have a minimum and maximum number of guests, your final number of confirmed guests will be implied by how many guests have been paid for by the payment deadline.

If the minimum amount of guests has not been paid for by the 72 hour deadline, your Booking will be cancelled. All amounts paid to us towards the Booking EXCEPT the original non-refundable payment of 4 guests’ cost will be refunded.

3. Refund Policy for Cancellation of the Entire Booking

In the case that you wish to cancel the entire Booking, our refund policy is as follows :

– If we’re notified on or before your due date for full payment*: we refund you all amounts paid to us towards the booking except your original non-refundable payment;

– If we’re notified after your due date for full payment*: we issue no refund.

If the group wishes to cancel the entire Booking, the Head Organizer must notify us by sending us an email to that effect.

* If you booked more than 7 days in advance, the due date for full payment is 7 days before the start of the Booking. If you booked 7 days or less in advance, the due date for full payment is 72 hours before the start of the Booking. Full details on due dates are in section 2 of these Terms & Conditions.

4. Changes in Group Size

Our prices are always quoted as “per person rates”. Every booking has a group size range for which the quoted “per person rate” is valid.

i) If your group size falls below the minimumof this range, the group will still be required to pay the “per person rate” for the minimum number of guests. For example, if the “per person rate” of your booking is $100 for a group size of 6-8 people – even if your group ends up being 5, you will still be required to pay for $600 total (6 people x $100).

ii) If your group size is larger than the maximum of this range, the Head Organizer should notify us by email at his / her earliest convenience, indicating that you wish to increase your group size. We do not guarantee that increasing your group size will always be possible, but if it is, each additional guest is to be charged the same “per person rate” of your booking + an additional $10 administrative fee.

5. Pricing Policy

All quotes obtained are valid for up to 14 days and subject to availability.

*Bookings made less than 7 days in advance are charged a 15% “last-minute” premium.*

6. Changes and Cancellations by Us

Very rarely, we have to make significant changes** to one or more Experiences in your Booking after it has officially been confirmed by us, or have to cancel one of more Experiences in your Booking.

If this happens, we will offer you the choice of the following options:

  1. Accept a change we will propose (for example, accepting a time change or a different Experience which we suggest).
  2. Cancel the effected Experience(s), which will reduce the per person price of the Booking (the revised pricing will be presented to you).
  3. Cancel the entire Booking and receive a full refund of any amounts paid towards the Booking.

No liability will be accepted and the above options will not be available if we cancel as a result of your failure to comply with any requirement of these Booking Terms and Conditions or if the change made is not considered to be significant.

** A significant change to your Booking is considered to be when we cannot provide one or more of the Experiences in your Booking, within 1 hour in either direction of your desired start time indicated upon booking, or in the case that no start time was specified by you, on the date you selected for the Experience to take place. Please note the above options are not available where the changes are not considered to be a significant — for example, time changes of up to 1 hour in either direction (see Timing section).

7. Weather Conditions

Unfortunately, there is always the risk that you may be unable to take part in weather dependent Experiences due to poor weather. If this occurs, you will be entitled to the options set out in the “Changes and Cancellations by Us” section.

8. Our Liability

  1. We will not be responsible for any injury, illness, death, imprisonment, loss (for example loss of enjoyment), emotional or psychological harm, damage, expense, cost or other sum or claim;
  2. We cannot accept any responsibility for any services which do not form part of your Booking with us. This includes, for example, accommodation;
  3. Some of the Experiences and events we offer are by their nature inherently dangerous. By participating in these you assume the inherent risks involved. We cannot be responsible for any injury or loss suffered by you. You should ensure that you have adequate and appropriate personal insurance which covers these particular Experiences and events.
  4. Our Experiences may sometimes be outside of your comfort zone. Please be aware that you are never under any obligation to participate in any Experience. We will not be responsible for any negative consequences of your participation, including psychological or emotional harm. Please inform us if you do not wish to participate in an Experience. If we are not informed that you do not wish to participate, your consent will be implied.

9. Your Liability

You agree to take full responsibility for the consequences of your own actions and behaviour.

You are liable for any damage or loss you caused. Full payment for any damage or loss (reasonably estimated if not precisely known) caused by you or any member of your Booking must be made direct to the Experience provider or to us as their agent as soon as possible. If the actual cost of the loss or damage exceeds the amount paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded. You will also be responsible for meeting any claims subsequently made against us or any Experience provider and all costs incurred by us / the supplier (including our own, the supplier’s and the other Booking’s full legal costs) as a result of your actions or behaviour. We reserve the right to pass your details on to an Experience provider, or third Booking debt recovery agency to reclaim any monies owing, including all additional costs of doing so.

You are also liable for any additional expense incurred which is not explicitly included in your Booking. For example, if a guest vomits in a limousine and a clean-up fee is charged to us, you would be responsible for this fee.

10. Timing

Upon booking, if you do not specify the start time of an Experience(s), we will have the right to choose any start time for this Experience(s) that we believe is appropriate.

Upon booking, if you specified the start time of an Experience(s), we retain the right to make minor changes to the start time you specified, up to 1 hour in either direction, without consulting you.

Should you wish to change the start time of an Experience(s) which you had indicated upon booking, please let us know as soon as possible. We do our best to accommodate these requests, and if enough notice is given, it usually is not a problem.

The finalized timing of Experiences will be outlined in the “Detailed Booking Schedule”. The Detailed Party Schedule will be provided to you 5 days before the start of your Booking if you have booked with more than 7 days in advance, or 48 hours before the start of your party if you have booked 7 days or less in advance.

You will be expected to abide by the finalized timing of the Detailed Booking Schedule. If you are late for an Experience, it may result in the cancellation of the Experience for which you are late, or the cancellation of a different Experience should your late start of one Experience effect your ability to arrive on time for another. In these cases, we will not be liable for any refund or compensation.

Furthermore, you will be responsible for any costs that may be incurred as a result of your tardiness. For example, if a limousine company charges us an additional fee as a result of the group being late for a scheduled pick up time, you would be responsible for payment of this fee.

Even after the timing has been finalized in the Detailed Booking Schedule, we reserve the right to make extremely small time changes of up to 15 minutes in either direction, up until 2 hours before the anticipated start time of Experience. In which case, you will be expected to respect the time change, and will be subject to the same consequences for tardiness as listed above.

11. Behaviour

When a Booking is booked through us, you are solely responsible for your behaviour throughout the Booking. You agree to conduct yourselves in an appropriate and lawful manner at all times throughout the Booking.

The following are strictly forbidden :

  1. Possession, use or distribution of illegal drugs;
  2. Making inappropriate sexual advances;
  3. Offering money in exchange for sex or sexual favours;
  4. Reckless and dangerous behaviour;
  5. Extreme intoxication;
  6. Disregarding the rules of our Experience providers (i.e. sneaking liquor into a bar);
  7. Violence and aggression;
  8. Intentionally damaging or defacing private or public property;
  9. Driving under the influence
  10. Participating in Experiences that require a high level of concentration under the influence of alcohol or drugs
  11. Generally speaking, any behaviour likely to cause distress, damage, danger or annoyance to other clients or members of the Booking, employees, suppliers, property or anyone else.

In any of the cases listed above, we reserve the right to prevent you from participating in a specific Experience or, in extreme cases, prevent you from participating in multiple or all remaining Experiences of the Booking. In these cases you would receive no refund for any of these Experiences which you are prevented from participated in. Please note that additionally, we have an obligation to report any illegal Experiences that we witness to the appropriate authorities.

You should also be reachable throughout the dates of the party on the Head Organizer’s phone number indicated upon booking. We accept no responsibility for any negative consequences resulting from us being unable to reach the group.

12. Health

Some of the Experiences you may book have fitness, health, strength, endurance, height and weight requirements. It is entirely your responsibility to ensure that you meet all of these requirements. If you are concerned about your ability to participate in a specific Experience, you must inform us before making any kind of payment. We will then advise you accordingly. If you have not informed us of any concerns and you are then unable to participate in an Experience due to any of these above-mentioned requirements, you will not receive any kind of refund for this Experience.

13. Complaints procedure

Should you be unhappy with any element of your Booking, you should notify the Experience provider immediately. If the problem still cannot be resolved, you should contact us as soon as possible at the time. If you continue to be dissatisfied on your return, you should email us formally setting out your points within 14 days following the end of your Package. As long as the above conditions have been observed, the matter will be investigated and a reply will be sent to you within three weeks of the receipt of the complaint. As it is difficult and sometimes impossible to properly investigate a complaint if suppliers/we are not told about it reasonably quickly, any compensation you may have been able to claim could be reduced or even lost altogether if you do not follow the complaints procedure set out in this clause. Any acceptance of liability by us is however subject to clause 7. In the very unlikely event that you have to pay the Experience provider directly for a cost that was supposed to be included in the Booking that you have paid us for, then you must collect a receipt and send it to us in order for us to reimburse those costs.

14. Documentation

All guests must be 18 years old or older for parties in the province of Alberta and 19 or older for parties in the province of British Columbia and must have two pieces of valid government- issued photo ID with them. Failure to have these in possession, may result in an inability to partake in certain Experiences (i.e. nightclubs, bars, etc.), in which case we would issue no refund.

15. Contradictory Information

Should we accidentally provide you with any contradictory information, the following list shows the order of precedence of the information :

  1. This contract
  2. Email correspondence with one of our representatives
  3. Information provided on our website
  4. Information provided through our website – for example, automatic emails

In other words, the information in this contract supersedes any contradicting information provided in any other way.

16. Governing Law

This agreement is governed, construed, and enforced in accordance with the laws of Province of Alberta, Canada.
